Lots of ifs and buts there, and it all seems hinged on the technicalities of a well-after-the-fact audit. While establishing mala fide intent might perhaps help point at at illegality, despite being couched in legal-enough-on-the-surface instruments and deals; but I don't know if that'll swing in Indian courts, and particularly given GSD's clout, and given what that religious clout might mean given the political climate in India at this time.

On the other hand, that's exactly how the Singh brothers got caught out, isn't it, via audits by Dai-Ichi well after the deal was signed, and assets and money already exchanged; so who knows, just maybe? ...Then again, and on the third hand, the actual catching-out by Dai-Ichi, that wasn't in an Indian court, was it? Singapore, I think it was? And in any case there was no religion involved there, and no-one in the cross-hairs with millions of followers, followers with votes: so again, who knows.

The accusations are significant, and yet they are entirely consistent with the earlier investigations and reporting. What has changed is the entrance of a new player, Dabur, offering to increase their holdings in Religare, to 26% by purchasing an additional 4.5% of Religare's total stock. This could, potentially, raise either cash assets and / or stock value that could be liquidated to cover the outstanding debts. At the very least, raising the paper value of the company temporarily can do much to restore credit rating and financing. It may actually be a smart move, to purchase Religare when it is somewhat distressed. The Dabur families' ties to Gurinder and company may be part of the backstory, but we do not know. And whether that actually helps the company or hurts it is also a matter of time to see.

Gurinder was most certainly involved. But whether that helped the Singh brothers avert even more disaster or promulgated that disaster; whether his influence harmed the companies, or in fact has been used to lessen the negative financial effects of poor decisions by the Singh brothers and others, we do not at this time know.

Brian, this is solid reporting. The accusations are from key members of the story, players who made poor decisions and tried to cover them up; and they are a bit clearer now, especially the detail on the arrangement between Gurinder and Malvinder, which was evidenced by Gurinder's letter to the Singh brothers, offering to take back all the debt along with the assets, when it appeared the Singh brothers were unable to restore the value of the stock, upon which the siphoned loans were all based. The letter, as we already know, is part of the legal evidence currently held by the court.

Influence and connections, including family ties, are a part of every society. And never more so than in the management of investment, corporate leadership and the stock market. It would be nice to offer equity to all in such interactions but we are far from that.

I do not think this reflects poorly on Gurinder at this time. He is managing a very, very complex interaction that he, for his own reasons, became significantly involved in. Illegal internal loans were made and taken to support a sagging stock market that threatened the various companies. A mortgaged property was booked as an asset.

Go back another couple of years, and it seems several family members attempted to get in on what started as a bull market, only to have huge liabilities on their hands when things went soft. Then, faced with mounting debt, it appears they used their status as members of Fortis and other Religare companies to make loans to help cover each others' debts, in the hopes of a market turn-around. Since so much of this was woven with family and friendship ties, it does not seem in any way unusual, though illegal. Under such influences, legal considerations are going to become secondary.

But I think asking Dabur to help out is not in and of itself wrong. If it helps Religare remain solvent, all the better. And if finding someone to blame helps buy the company time and financial ranking to finance Religare's emergence from debt, then, if Gurinder or God Herself elects that Gurinder must be the fall guy, so be it.

When the stock market appears strong, people who have access to significant funds understand that their money can double overnight with the right investments. And when, after attempting to do so with what ends up as a soft market, their own company runs into financial difficulty, finding ways to create assets as the basis for temporary loans to attempt further investment can happen as easily as any addiction.

It's a risky business. Anyone who engages in corporate leadership and influence plays a serious game. But to what extent is Gurinder using his influence to keep these large entities and the wealth of his colleagues' families from failing, basically maintaining existing stock-holder equity or even raising it, amidst a series of risky decisions by others, and to what extent did his influence further harm the company?

Time will tell.


Spence Tepper, it's hard to believe that you read the stories I shared before you wrote your misleading comment. In these stories, as with the earlier stories in the Indian financial press about the involvement of the RSSB guru in financial fraud, there is zero evidence, ZERO, that Gurinder Singh Dhillon was trying to help Religare through the huge amounts of money being siphoned out of Religare through shell companies engaging in short-term movements of money that ended up in the hands of the Dhillon family.

The allegation by the new Religare board and Malvinder Singh is that the RSSB guru enriched himself to about $120 million that belonged to Religare. Yet you somehow twist things around in an attempt to make the guru into some sort of savior of Religare. Why would the board ask the Delhi police to investigate the guru if Religare had been helped by him, rather than hurt? I realize that you are devoted to Gurinder Singh Dhillon and want to see him in the best possible light, but the light you're casting on him is preventing you from seeing what lurks in the shadows of the guru's actions.

Appreciative Reader, you are appropriately skeptical of the Indian legal system, which so far has been dreadfully slow and unresponsive to the allegations of financial fraud leveled against the RSSB guru. It may well be that the guru isn't held to account because of political interference in the legal process. I hope this doesn't occur, for the sake of justice and also for the sake of India.

If Indian corporations can lose hundreds of millions of dollars through fraud, yet those responsible for the fraud go unpunished, that sends a message to investors, both in India and foreigners, that justice is in short supple in the Indian legal system. This isn't a positive for the economic development of India, obviously.

As one of the mentors who guided Malvinder and Shivinder into starting Religare in 1984, it is just possible that this is what he is trying to do.

As I wrote, we don't know if his actions helped or hurt. Only that he was involved. And that whatever good was done in creating Religare, fraud has placed the company in some distress. But it is solvent today, growing and with international investors.

Sometimes companies grow well beyond the competency level of their founders. And their errors become the basis for some desperate acts, and that becomes the basis for transition.

I suspect, after all that has happened, he is doing everything in his power to help, including encouraging the Burman family to invest more and become the largest investors in the company.

Every investor, however they choose to act, wants to make a return, and no better place than where things appear in distress. Hence the implication in the press that the Dabur investments may have been in some way connected to him makes sense for any investor, whatever you may attribute to them.

We know that fraud took place, and among his relatives. We know he gave full access to his bank accounts to Malvinder and Shivinder, and they used these accounts to launder the fraudulent loans.

And we also know he offered to take back Malvinder and Shivinder's holdings and all the debt connected to it. That doesn't look like the actions of someone who wants to cut and run or avoid personal responsibility. It appears to be the actions of someone who wants to help. It is possible his intentions were to reverse the misfortunes of his, his family and all family and friends involved in this. Because they are still around, and in his sphere.

Why help found a corporation that indeed grew to become one of the largest financial and banking giants in the world, only with the purpose of fraud when your name is in the press and everyone knows where you live?

It might be so, but less likely than that the relatives he encouraged to go big, take advantage of the financial opportunity at the time in India and the region, in founding Religare stretched well beyond their management capacity, and grew desperate, and that he has made every effort to get them quietly out of hot water.

The idea that GSD might have been toiling away to increase shareholder value at Religare is completely risible, despite the equivocation built in. The man has neither the professional qualifications, nor expertise, nor any past record of corporate consulting at this level, as far as I am aware. All he was, professionally, is some sales whatsit in some European backwaters. Certainly he couldn't have commanded anywhere close to the millions he siphoned off, he and his sons, without leveraging his position as RSSB "master".

Naturally we cannot, with certitude, rule out his having worked wonders and stemmed even greater loss through wise advice, not without a detailed audit of what happened. But that's like saying we can't say for sure that Trump may not have saved the world from annihilation in a nuclear war, in a hush-hush deal that leveraged his friendship with Putin and the NK weirdo dictator, not without a careful audit of all classified intel.

Certainly, should clear evidence emerge that this man did magically provide sterling advice and strategic and legal corporate guidance despite the lack of qualifications and record of experience in corporate strategy, well then we'd be open to accepting that, obviously. That's always true, that openness to changing one's mind. But there's no way to finesse, to spin, that openness, into this absurd equivalence.

The only question is whether the on-surface-apparently-legal contracts and deals, whose criminality is hinged on their mala fide intent and specifically the deliberately sloppy due diligence, will be shown up in Indian courts. Given India's politics, it well may not.

And agreed, Brian, that reflects very badly indeed on India, and on where the country's headed.

Attention criminals, this is how to get away with theft. Just have your partners in crime sign a document that absolves you from any legal culpability. That way, the police can't file criminal charges against you. If they do, you just show em the signed document and watch them take off their hats to scratch their heads. "Gosh Paddy, we can't arrest the guy, he's got a signed document that he can't be sued or arrested."

Anyway, good to know that Malvinder and his brother are doing well. Oh wait, they're still in jail for embezzlement.

On a serious note, I admit that it's at least possible that satsangis involved in a business arrangement with their guru might be willing to do anything to make said guru happy. But the confounding thing about this Ranbaxy saga is the precise terms of these "loans." Was Gurinder bending the brothers' arms to suck crores out of Ranbaxy like Tony Soprano, or were these brothers so eager to please Gurinder that they went off the deep end in authorizing these fund transfers and lied about their legality, or were all parties involved simply irresponsible and/or ignorant of the financial peril they were creating (let's remember they were gifted this huge wealth and responsibility with the demise of their father and were far less business savvy than their appeared) or was it a combination of all of this with the brothers bolstered by the faith that everything would work out in the end, since they were working with the guru?

Again, I think it's at least possible that Gurinder may have exploited the brothers' willingness to please him.

The argument that Gurinder should have prevented this fiasco "because he's God and should have known what would happen" I guess has some merit, but not much, since, again, we still don't know the terms of the business loans. That said, we can play the useful game of putting ourselves in Gurinder's shoes per this deal gone wrong. Say we had a nephew who was the CEO of Delta Airlines, and he came to us, or we asked him, to loan us tens of millions of dollars from his corporation.

That would seem far from kosher, and yet we must add in the cultural factors here. As others have reported, many at the Dera felt that it was Gurinder who ran and owned Ranbaxy. No, Gurinder wasn't the legal owner but effectively was considered that corp's owner in that weird Indian family dynamic of shared wealth.

The Indian family dynamic was responsible for some amazing financial miracles for Sant Mat gurus.
It provided gurus like Charan Singh and Rajinder Singh was abundant wealth "from their families."

One of the pillars of Sant Mat ethics is that the guru should be self-supporting. But I digress...

For those who were baffled the atrocious syntax of the Indian English the posted news story, here's the matter written by good Reuter's reporters:

NEW DELHI, Oct 11 (Reuters) - Indian financial services company Religare Enterprises (RELG.NS) has asked police to start a fresh investigation related to alleged siphoning of funds and certain business dealings done under its previous leadership, a company letter shows.

The news comes just weeks after India's billionaire Burman family, which founded consumer goods conglomerate Dabur, announced plans in September to raise its stake to take control of Religare by investing $255 million.

Religare's former owners, brothers Malvinder Singh and Shivinder Singh, resigned from the board in 2018 and are among those who have faced many investigations for alleged siphoning of 45 billion rupees ($541 million) from Religare. The brothers, who deny wrongdoing, are currently on bail after being jailed earlier.

After new management conducted internal probes starting 2018, Religare filed various complaints to investigate alleged wrongdoings and recover funds.

In an Oct. 6 letter to Delhi police, Religare called for a "fair & proper investigation" into past financial dealings and said some of the complaints it filed during 2019-2023 had not been looked into.

"Any unlawful loss caused to its (Religare) subsidiaries affects REL's public shareholders," its Vice President Legal, Manpreet Singh Suri, wrote in the letter, which has not been made public but has been reviewed by Reuters.

Asked about the letter, Religare said in a statement its management "will continue pursuing all the legal actions rigorously".

A representative of the Burman family, Mohit Burman, said "we would like to see the company (Religare) use all legal remedies to recover any funds that are due."

The Delhi police and the Singh brothers did not immediately respond to Reuters queries.

Religare provides loans to small and mid-sized businesses and also has health insurance and broking services units.

A takeover by the Burmans would pit the billionaire family against other prominent names in the same business, including tycoon Mukesh Ambani's Jio Financial Services (JIOF.NS).

Anyway, it does seem that REL board's requested new investigation is tacitly pointed at Gurinder. Or perhaps that's just an assumption fueled by GDS. In any case, it seems that the interested parties' legal teams are not very impressed by the scope and scale of whatever investigations the Indian legal system has done. And I can't say I blame them for wanting a deeper dive into who did what, where all the money went, and how all this was allowed to happen.

While some of his family member's excuses were possibly reasonable, Gurinder's claim that he couldn't go to court because he was "a cancer survivor and had diabetes" is weak.

And then there's the matter of the displaced money. Imagine Gurinder meeting Burman, what do you suppose would Burman's first question? "Hey, you somehow ended up with tens of millions of dollars from the company...well?"

No, I doubt if Gurinder would ever even meet with Burman, just as Gurinder wouldn't go to court, or speak to the press, or the Sangat.

As you know I'm not one to assign blame to Gurinder for the money problem, but on the other hand, he has acted abominably slippery throughout this saga. So it kind of irks me when people say he's no doubt "eager to help."

You're citing his experience with that same broad group, his qualifications to professionally consult which is what is being questioned?

I've some fairly solid experience in corporate consulting myself. As do you, I believe. And that is NOT what a respectable consultant profile remotely looks like, that might command hundreds of thousands --- leave alone millions --- in direct and indirect remuneration. And you well know that.

I may be wrong but I remember that in the beginning there was something about a large number of shares being given to GSD's sons, and his wife, just before the company went public. This was a way to avoid taxes and GSD's family would be rich in the process.

Then is appears these funds were being diverted each year and returned just before the annual audit, for audit purposes. When the singh brothers were in financial trouble due to the dehli case filed by the japanese buyer of the company (was it religare or fortis or another?). The singh brothers appealed to GSD to help them out of a difficult financial situation. He declined and said it was not his job to help them.
As far as I understood - this was the cause of the problems. The singh brothers explained that if he doesn't help, the company will be taken away from them and all the illegal loans would become public knowledge.
At that point - GSD should have helped - for his own sake. But he didn't and then it was too late. It was all avoidable if GSD had helped the singh borthers. After all, his wealth came from them and a bit of appreciation would have gone a long way. But he refused to help and then everyone was in trouble. His wife played a key role as she was director of some of the offshore companies.

That is why she died - evidence eliminated - end of case.

But now it seems justice may still be served.

This story has nothing to do with spirituality or atheism. It’s about one thing, and one thing only (which Americans are all too familiar with)—GREED.

I do not know how you came to decide for your self that I am defending GSD.

For a student, deciple, follower ther should be just one question ..am I the best student I can be.

Or a mundane example .. instead of asking whether my partner is deserving my attention, respect, love etc one could ask if one i9s the best possible partner to the other.

Unfortunately these understanding are not easy acceptable when young..

Even if he is convicted for this are that financial trespassing of law, would be of no importance and meaning to me .. but I do not happen to be his disciple.
I have fond memories of interacting with him and nothing and nobody is going to deprive me from them ... and I will certainly destroy what is dear to mee ... hahahaha

Why should I stop drinking a certain brand coffee that gave me pleasure when it uis found that the CEO not payed his taxes ... hahaha
