Following the arrest of Malvinder and Shivinder Singh by Delhi police for questioning about the diversion of funds from companies they once controlled,(see here and here), and the High Court of Delhi giving the guru of Radha Soami Satsang Beas, along with others, 30 days to pay back $842 million to the Religare corporation, there's more fascinating news.
Likely reflecting what his client is telling authorities, Malvinder Singh's attorney had some harsh words for Gurinder Singh Dhillon, the RSSB guru. At one time the Singh brothers treated Dhillon, their relative, as both a father figure and trusted spiritual adviser on matters both financial and religious.
But now, according to a story in the Indian Express, things are very different. I've boldfaced the mentions of the RSSB guru and co-conspirators.
A day after they were arrested for alleged diversion of funds and causing a loss of Rs 2,397 crore to Religare Finvest Ltd (RFL), brothers Malvinder Singh and Shivinder Singh, former promoters of Religare Enterprises Ltd, were remanded in four-day police custody Friday.
Before they were led away with three others arrested with them, Malvinder’s counsel Manu Sharma told a Delhi court that his client did not have a “single penny” and that investigators were not arresting a “a person to whose doorstep the money leads as he is heading a great religious organisation”.
“This gentleman runs an entity called Radha Soami Satsang Beas (RSSB) trust. He’s a very powerful man and has high political relevance,” Sharma told the court of Chief Metropolitan Magistrate Deepak Sherawat at the Saket courts complex in south Delhi.
At one stage, the Singh brothers were followers of the RSSB.
He said the FIR against Malvinder is an offshoot of a September 27 order of the Delhi High Court which ordered 55 entities and individuals, including RSSB chief Gurinder Singh Dhillon, his family members and various companies owned by them or by RSSB associates, to pay dues of over Rs 3,000 to the Singh brothers.
“\After this (High Court) order was reported two days back, my client was detained on the intervening night of Thursday and Friday and arrested before his wife and daughter, who is undergoing treatment at a hospital in Ludhiana,” Sharma told the court.
Besides Malvinder and Shivinder, the Economic Offences Wing of Delhi Police Thursday arrested Sunil Godhwani, former chairman and managing director of Religare Enterprises Ltd (REL), Kavi Arora and Anil Saxena who held “important managerial positions in REL and RFL” for alleged diversion of public money “in clandestine manner for their own benefit.
Noting that “the offence is of very serious nature involving huge amount of siphoning of money”, CMM Sherawat ordered their police custody since it is “necessary to trace the trail of the cheated amount and find out the role of other persons who might have participated in conspiracy, and confrontation with other officials of RFL and REL”. He directed that the accused be produced in court again on October 15.
The court granted four-day police custody though the EOW had sought six days, saying they also needed to ascertain the role of co-conspirators.
Godhwani and Saxena did not oppose the police remand while Shivinder told the court that he himself was a victim of the fraud and would cooperate with the investigation in every possible manner.
Malvinder’s lawyer Sharma told the court that he had given an affidavit in the High Court saying the money was not with him. Maintaining that his client had been cooperating, he said: “I am a defenceless and a penniless man. The agency should arrest the RSSB chief who has not even been touched.”
Meanwhile, the RSSB chief and his family members moved the High Court Friday, saying they do not owe any money to RHC Holdings Pvt Ltd, promoted by Malvinder and Shivinder.

Where is the call to arrest Gurinder Singh Dhillon, barring Malvinder's affidavit issued through his lawyer suggesting that his client (Malvinder) has called for the courts mercies as he is now a 'defenceless penniless man' and the agency should be directed to arrest the RSSB chief.?
This position Malvinder finds himself in is of his own making, he should retrace his own actions in his capacity as chief managing officer of Ranbaxy prior to FDA rejection of Ranbaxy's manufacturing of substandard drugs, and his handling of REL and RHC holdings finances subsequent to the sale to Daiichi Sankyo for $2 Billion.
Now he seeks courts sympathy for the years of unscrupulous manufacturing processes which is the kernel of the saga, and which is why Daiichi sought recompense via arbitration for having bought a relatively defunct company, and whereby the proceeds from said sale were long since invested in fixed assets elsewhere prior to Daiichi Sankyo's success in obtaining the arbitration ruling.

Yes, and it's common in India. But wasn't Gurinder on the board of some of the larger companies himself? He was so involved publicly that it'd be a hard sell to convince anyone that at his level of involvement he didn't know about the operations of these companies. He would have known about these shell companies for quite a long time, and you'd think that he would have pressed charges himself by now.
Also, he's massively rich. Where did he think the money was coming from? Sat Purush?

If you look at the article on the RSSB website it details a few of the shell companies, and highlights in particular those with Gurinder's wife listed as principle.
The information has been in the press over the last two years.
And it details the loans from the sale of Ranbaxy that went to Gurinder et al. It also details that when Gurinder could not pay and became delinquent, his assets were held by the investors.
Why would RSSB post a fictitious article?
The fact they posted it as part of truth in disclosure and transparency, has seriously weakened Gurinder's current claim he owes nothing.
Then there are the mountains of paper evidence in the papers of incorporation of these many different companies, as well as the annual financial statements, and the various loan documents, since all of these required signature by either the principles (Gurinder, his wife and sons), or the loan recipients (Gurinder, his wife and sons).
That means hundreds of documents over the last ten years of financial diversion detailing the loans, signed by Gurinder, his wife, sons, at all. And that is a mountain of evidence. If it doesn't exist, Gurindar's case for innocence becomes very strong.
If the dozens of signatures made over several years match, he's toast.
These are all available to the police for investigation. They are publicly registered legal documents. The crimes division will match the dates and amounts and look for corroborating witnesses to the events.

You could be right. I'm just saying that I don't know the precise legal structure of these "shell companies" and who actually controlled them, and on what precise basis (if any) were the Dhillon family members aware of and in control of these entities. In other words, is it possible that someone could be listed as the principal of an Indian shell company and yet have never known about it, or had any control of the funds that went in and out of it?
I know nothing about Indian finance law, but the fact that Gurinder showed up to the court to say he'd received no money is either a colossally boldfaced public lie to an Indian judge, or it really is the truth.

J, where did you read that Gurinder told the court he'd received no money? From the stories I've read, Gurinder's attorney challenged the court order to repay the money.
It seems next to impossible that Gurinder and his family received no money from companies once controlled by the Singh brothers and Godhwani, since their receipt of lots of money has been reported many times in the Indian financial press with no pushback or denials from Gurinder or his attorney.

Gurinder stated it himself publicly in Petaluma in open discussion to a question posed about the 'financial scandal' where he outright stated he hasn't taken anything from anyone for his own personal uses other than from his parents.
Plus when questioned about it in Singapore he responded with 'tell them the Baba was getting bored so he decided to come with a "Bang"

clearly he received money, only an idiot would say he received no money. the question is only if he owes the money back or if he received it for another reason.
if it was a loan then it has to be repaid. but he will claim it was a business transaction and the money was a payment in the same way that you get paid for any service you perform.
if it was a payment for services/goods provided then its not a loan. so that is all the guru is claiming. he cannot den receiving the money but he can deny that it was a loan. obviously there is no written document so it will be a court decision.

The RSSB website article details the hundreds of millions of dollars of stock sold to Gurinder by the Singh Brothers as part of the sale of Ranbaxy. These were all paid as bank debenture loans with a very high percentage.

The real estate didn't climb in value high enough to meet the loan payments. And then investors held Gurinder's assets.
In short Gurinder et all received loans (convertable bank debentures) used to buy stock, and then real estate.
He was delinquent. He didn't repay them.
His assets were held, as stated on the RSSB website article.
It happened.
Why Gurinder would lie about it now is a question to be answered in court.
What happened with Malvinder, Shivinder and Sunhil is that they set up shell companies with Gurinder's family to siphon money from publicly held companies they also controlled, Fortis and Religar Finvest, in the form of unsecured loans to private shell companies that further siphoned money through loans to the ailing real estate companies owned by Gurinder et AL.
But that is fraud.

The Dhillons approached the court to say that they do not owe the Singh brothers anything.
A few months ago there was so much talk here as to why would these 2 brothers would loan leaps of money to the Dhillons. What’s the reason? Well perhaps they never did.
The could have cooked the books. Shivinder did claim Malvinder forged his wife’s signatures. And in the beginning they both claimed BBJ had no involvement. Read Malvinders letters and it’s clear that’s the tone of someone who is owed money. Something switched and he hatched up this whole story.
Bottom line is this—if you trust the Guru his teaching and that he would exemplify that in his life then there is no question to all this.

None of the Sant Mat Masters encourage blind faith, including Gurinder.
If the years of signed documents as principles of companies and on loans were forged, the courts will uncover it. These documents and the witnesses to the events, form the bulk of the mountain of evidence.
It isn't evidence of Gurinder's personal involvement. Only evidence that he and family members took thousands of crore and didn't pay it back. And until now, Gurinder et al has not assisted any authority in getting to the bottom of the fraud, even after being ordered by the high court in June to pay, and now being delinquent in meeting that deadline. He simply had not cooperated with the authorities.
However, with the second order to pay and the arrests this week of Malvinder, Shivinder (whom he was grooming to be the next Master) and Sunhil, Gurinder's lawyer submitted a statement that Gurinder is innocent, received no loans, owes no money. But the evidence suggests otherwise.
From the article on the RSSB website we do read that Gurinder and his wife had very close ties to Sunhil, one of the principles advised of fraud.... And invited him to manage their foray into the investment world, at he was already managing the finances of the Dera.
"Sunny, as Sunil Godhwani is known among friends, was brought in to manage the finances of the dera during the churn that took place after the passing of Charan Singh in the early years of the new master Dhillon.
" Some old-time mutual-fund managers remember interacting with Sunil Godhwani for the investment of dera’s funds. Thus, he quickly became part of the inner circle of the new master. No wonder when the Dhillon family chose to enter the corporate world, they chose to go with Sunny.
"The Articles of Association of Luminous, when originally filed in April 2002, showed that Sunil Godhwani and Shabnam Dhillon were its first directors. Sunil Godhwani continued on the board of Luminous till October 2007, when he took Religare Enterprises to its IPO.

About a month later, Yuvraj Gorwaney also resigned from the boards of Prius Commercial projects and its subsidiaries.
"However, Rajveer Singh continued to be on several other companies of the Singh brothers. These include Best Healthcare, Fern Healthcare, and Modland Wears, all three named in the recent Luthra & Luthra report as alleged recipients of money allegedly siphoned from Fortis Healthcare."
Please consider the severe questioning Malvinder, Shivinder and Sunhil are undergoing right now while in jail.
Of course the issue of Gurinder's involvement is coming up. And the crimes division is searching for corroborating witness to the paper work. And if that evidence does corroborate, some plea bargaining as well.
In short, the crimes division now has the complete attention of Mal, Shiv and Sunhil. They want to get to the bottom of this, perhaps because they suspect it isn't with these three.
If it were, there world be no need to arrest them.
They are working their way up the food chain of one of India 's largest and most complex frauds in recent history. And in a matter of days or weeks they will have their case.

What's fuzzy to me is what "received" precisely means in the context of these shell companies. You and others are more familiar with the court cases and media reports on this issue. But at this point, it's not at all clear to me that evidence has been put forward that the money going through these accounts was necessarily controlled by the people listed as principles, or that they were the final destination of the money. Who listed these people as principles and who created these shell accounts, and do we know to what extent -- if any -- was the money entering and leaving these accounts the actual property of the principles? In other words, could the listing of Dhillons as principles have been done not by the Dhillons to enrich themselves, but by Malvinder and his cohorts to employ familiars in a financial scheme? Was this money invested in real estate belongs to these principles, or did the money just flow through the accounts to end up somewhere else, and belonging to someone else?
Comments in some of the latest media stories lead me to doubt that we actually know if the missing money all ended up literally and effectively owned by the Dhillon family. Yes, we have a court ordering the Dhillon's to pay the money back, but I'm just putting forward the possibility (and granted, a lot of it is speculation) that things may not be exactly as they seem.

If any harm comes to Shivinder, Malvinder or Sunhil between now and their trial, which could provide compromising witness to Gurindar's involvement, there will be support for the earlier death threat claims.
Wasn't the alleged death threat from an attorney? If so, the
instigator could be anyone. The tape could be doctored too.
Was there any evidence that the source was GSD or family?
Absent that, this devolves quickly into conspiracy theories.

Comments in some of the latest media stories lead me to doubt that we actually know if the missing money all ended up literally and effectively owned by the Dhillon family.
I think that's a salient point. Were the shell entities just
transit stops in the laundering scheme? Who profited
when the money left the laundromat?
The Dhillons are on the hook for repayment but is that
definitive? Could the garnishee order be an attempt to
flush out some one who knows who the actual perp is?

Me: No doubt, Lane is still the best Candidate, and its way past time to take the Turban off the Radhasoami Gurus, as Lane long ago published in his Book,...”The Guru Has No Turban. They are sons of a lady named Nimmi Singh who is the only daughter of Charan Singh, and it is well known that Charan loved her very much (as every father would normally do). So, Charan Singh was Nana (maternal grand father) of "singh bros", whom you are calling "CHORs" (thieves).
As everyone here knows, Charan Singh only appointed GSD as his successor.

Just FYI, as I wrote / explained in the post above, GSD is a cousin of Nimmi (Charan's daughter) and so he is a maternal uncle (also called "Mama" in Hindi) of Malvinder and Shivender Singh.
Although it does not matter much in the context of the discussions here, I thought it's worth noting as GSD has been referred to as a cousin of Malvinder and Shivender Singh in multiple posts earlier.
